Terms of Service

These terms are an agreement between you and CloudSurf Software LLC (Las Vegas, Nevada — "CloudSurf", "we", "us"). They cover Surfspace — the surf.space web app, the Surfspace apps for iPhone, iPad, Android, and Mac, and the Surfspace Terminal — the sites, docs, code repos, and storefronts you publish through Surfspace, wherever we serve them (including doc.surf addresses), and the cloudsurf.com website (together, the "Services"). They're written in plain English on purpose.

By creating an account, you agree to these terms and to our Privacy Policy. If you're visiting a public page, a published site, or a public code repo without an account — including filing an issue or opening a pull request — the sections on acceptable use, content, copyright, and disclaimers still apply to you.

Who can use Surfspace

You must be at least 17 years old to use Surfspace, and old enough to form a binding agreement where you live. If you're under the age of majority, a parent or guardian must agree to these terms for you. If you use Surfspace for an organization, you're agreeing on its behalf and telling us you have the authority to do that.

Your account

Keep your sign-in credentials to yourself and give us accurate information. You're responsible for what happens under your account, unless it happens because we failed to secure our systems. If you verify your phone number, we'll text you a one-time code — message and data rates may apply. If you think someone else has gotten into your account, tell us right away at team@cloudsurf.com.

You can delete your account at any time from your account settings in the app, or by emailing us — see Data deletion in the Privacy Policy.

Plans, billing & renewal

Surfspace has a free plan and several paid plans. Current plans, prices, credit allotments, and limits are listed at surf.space/pricing — that page is the canonical reference and these terms don't repeat its numbers.

  • Per seat, per workspace. Paid plans are billed per seat — one person's paid access to one workspace. A workspace can mix funding sources — different members' seats can be paid through different channels.
  • Auto-renewal. Subscriptions renew automatically each billing period (monthly or annual) until you cancel. Cancel any time: on the web, through the billing portal in Settings → Billing; on iPhone or Android, through your Apple or Google subscription settings. Cancelling stops future renewals — you keep access for the period you've already paid for.
  • Where you buy matters. Purchases on the web and desktop are processed by Stripe. Purchases inside the iPhone and Android apps go through Apple or Google, and their terms and refund processes apply to those purchases. Some plans are only available on the web.
  • Price changes. If we change a price, the change takes effect at your next renewal — never mid-period — and we'll email you at least 30 days before the renewal it applies to, so you can cancel first if you don't want it.
  • Refunds. Except where the law requires otherwise, payments are non-refundable and we don't prorate mid-period. For purchases made through Apple or Google, refund requests go through them.
  • If you're in the EU, EEA, or UK. For purchases made on the web, you have a legal right to withdraw within 14 days of purchase. Email team@cloudsurf.com within that window and we'll refund you, less a proportionate amount for service already provided. Purchases made through Apple or Google follow their withdrawal processes.
  • Fair use of promotions. A promo code can be redeemed once per workspace, promotions can't be combined, sold, or transferred, and we can withdraw a promotion that's being abused.

Credits

AI usage on Surfspace is metered in credits.

  • Your plan includes a monthly credit allotment, pooled per workspace. Included credits reset each month and don't roll over. Credits you purchase separately (top-up packs) do carry over until you use them.
  • Credits are not money. They have no cash value, can't be transferred or redeemed, and — except where the law requires — aren't refundable.
  • When a workspace runs low, usage may be throttled to economy models; when the balance hits zero, paid AI features pause until the next reset or a top-up. Running out of credits never locks up your content — everything you've made stays accessible and exportable, credits or not.
  • Auto-top-up is opt-in and off by default. If you turn it on, we charge your saved card for the pack you chose whenever the balance crosses your threshold, never more than the monthly cap you can see in Settings → Billing, and we turn it off automatically (and tell you) after repeated card declines.
  • If you cancel a paid plan, we don't claw back the credits you already have.
  • Workspace admins can open their workspace's pooled credits to members without seats, subject to a fair-use share per member. Admins can also restrict AI access to seated members only.

Your content

The docs, chats, apps, sites, code, and images you create on Surfspace are your content — it belongs to you.

To run the product, you give us the limited permissions we actually need: to store your content, back it up, process it when you ask us to (for example, sending a message to Surfy or building an app), send it to a third-party service when you direct us to (like pushing code to your connected GitHub account), and display it — to you, to workspace members you share it with, and to the public if you choose to publish it. That permission ends when you delete the content or your account, except for the residual backup copies described in the Privacy Policy.

AI output is yours too. As between you and CloudSurf, we claim no ownership of the things Surfy generates for you — the apps, code, docs, and images are yours to use, including commercially. Two honest caveats: AI output can be wrong, and similar prompts can produce similar output for other people — so no one, including us, can promise output is unique or accurate. Review before you rely on it.

No lock-in. Your work is portable — apps and docs are text files you can export and take anywhere, and code repos are standard git you can clone. That's a design commitment, not just a policy.

Your content is never sold and never used to train models — see the Privacy Policy for exactly how AI processing works, including the third-party model providers we use.

Publishing to the world

Surfspace lets you make things public: publish a site, share a doc publicly, make a code repo public, or open a storefront in your app. Nothing is public by default — new docs, apps, and repos start out visible only inside their workspace, and nothing goes public until you choose to publish it.

When you publish, you're the publisher. You're responsible for what you make public, you promise you have the rights to it, and you agree it follows the Acceptable use rules. If you connect a custom domain, you're telling us you own or control it, and content served on it counts as published content under these terms. We host published content as an intermediary; we don't review it in advance and it doesn't represent us.

We can unpublish or remove content, or suspend the account behind it, when something violates these terms or the law — see Enforcement. If you see abusive content on a Surfspace site or app, report it in the app where a report option is available, or email team@cloudsurf.com — either way, we'll look at it.

Selling through your app

Storefronts are in early access — selling through a Surfspace app isn't generally available yet, and commerce can only be enabled by arrangement with us. Interested? Email team@cloudsurf.com.

When commerce is enabled for your app: you must be at least 18 years old (or the age of majority where you live), and you are the seller — responsible for what you sell, for describing it honestly, for delivering it, for your own refund and support obligations, for taxes, and for complying with the laws that apply to your business. Payment processing, fees, and payout terms are agreed with us when we enable commerce for your app. Before storefronts open up generally, we'll publish standard commerce terms — and update this section first.

Don't sell anything illegal, and don't use Surfspace commerce for businesses that payment networks prohibit. We can suspend a storefront that breaks these rules.

Acceptable use

Don't use Surfspace to harm people or the service. Specifically, don't:

  • do anything illegal, or publish content you don't have the right to publish;
  • publish or distribute malware, phishing, or scams;
  • post content that sexually exploits children — this results in account termination and a report to the authorities;
  • harass, threaten, or defame people, or publish hate speech;
  • send spam — messages, docs, issues, or sites;
  • probe, overload, or interfere with the service, evade rate limits, scrape at scale, or access other people's workspaces or data without permission (security research on your own workspace is fine; if you find a vulnerability, tell us at team@cloudsurf.com);
  • resell access to the Services or share one seat between multiple people;
  • misrepresent who you are or who published something.

We enforce these rules with content removal, unpublishing, rate limits, and account suspension, scaled to the severity of the problem.

If you believe content on Surfspace infringes your copyright, send a notice to our designated agent, registered in the US Copyright Office's DMCA Designated Agent Directory:

Include the material's location, a description of the work infringed, your contact information, a statement that you believe in good faith the use is unauthorized, a statement — made under penalty of perjury — that your notice is accurate and that you're authorized to act for the rights holder, and your physical or electronic signature. When a notice checks out, we remove or disable the content, notify the publisher (who may send a counter-notice), and terminate repeat infringers' accounts.

Connected apps & API keys

You can mint API keys and connect outside apps (including MCP clients) to a workspace. Each key is pinned to one workspace and to the permissions you give it. You're responsible for what your keys do — keep them secret, and revoke any key you no longer trust (Settings → Account → Manage API Keys; revocation takes effect right away). API usage is subject to per-plan rate limits shown in your account settings.

Your devices

You can register your own computers with a workspace to run builds, serve models, or give Surfspace access to their files. Device actions travel through our servers — nothing addresses your device directly — only to devices registered in the workspace, and only using the capabilities enabled on that device. A registered device is shared workspace equipment: workspace members with editor access can use it and remove it, so only register a device into a workspace whose members you trust. You're responsible for the devices you register and for anything they serve into your workspace. Remove a device at any time from the Devices page.

CloudSurf's stuff

The Services themselves — the Surfspace software, Surfy, the SurfDoc format tooling, our sites, and our trademarks (CloudSurf, Surfspace, SurfDoc, WaveSite, and friends) — belong to CloudSurf and our licensors. We give you a personal, non-exclusive, non-transferable license to use the apps as part of the Services. Don't copy our branding or pass our Services off as yours. Feedback you send us can be used to improve the product without obligation.

Apple & Google

For the iPhone, iPad, and Mac apps from the App Store: Apple's standard licensed-application terms govern the app binary itself, and your license to the apps is limited to Apple-branded devices you own or control, as the App Store Usage Rules allow. Apple is not responsible for the apps or the Services, has no obligation to maintain or support them, and if an app fails to conform to a warranty, Apple's only responsibility is to refund its purchase price. CloudSurf — not Apple — is responsible for the apps, for any product or legal claims about them, and for any third-party claim that they infringe intellectual property. You confirm you're not located in a country under a U.S. government embargo and aren't on any U.S. government list of prohibited or restricted parties. Apple (and its subsidiaries) is a third-party beneficiary of these terms with the right to enforce them against you. In-app purchases follow Apple's payment, renewal, and refund rules. The equivalent applies to Google Play for the Android app.

Leaving, and being asked to leave

You can leave any time. Export your work, then delete your account in Settings — everything goes, per the Privacy Policy.

We can suspend or terminate accounts that violate these terms, create legal risk, or attack the service — proportionally: for most violations we'll remove the offending content or warn you first; for serious ones (illegal content, malware, child-safety violations) suspension is immediate. If we suspend your account, we'll still give you a reasonable window to export your content, unless the law or the nature of the violation (for example, illegal content) prevents it. If you think we got it wrong, reply to the notice or email team@cloudsurf.com.

If we terminate your account for a violation, unused credits and fees are forfeited. If we ever terminate for any other reason — or discontinue the Services — we'll give you reasonable notice and time to export your content, and we'll refund purchased credits you haven't used and the unused part of any prepaid period.

The sections on liability, your responsibility to us, and disputes survive after your account is closed.

No warranties

Surfspace is provided "as is." We work hard to keep it fast and reliable, but we can't promise it will always be available, error-free, or that AI output will be accurate or fit for any particular purpose. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. You're responsible for maintaining your own copies of critical work — export tools are built into the product — and for reviewing AI output before relying on it.

Limits on liability

To the fullest extent the law allows: neither CloudSurf nor its suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and our total liability for all claims arising out of the Services is capped at the greater of $100 or the amount you paid us in the 12 months before the claim. Some places don't allow certain limits, so parts of this section may not apply to you. Nothing in these terms excludes liability that can't legally be excluded.

Your responsibility to us

If someone brings a claim against CloudSurf because of content you published, something you sold through your app, or your violation of these terms, you agree to cover the costs and damages arising from that claim.

Disputes & governing law

These terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules.

Talk to us first. Before starting any formal dispute, email us at team@cloudsurf.com with a description of the problem and give us 30 days to work it out with you — most things are fixable.

Any dispute we can't resolve informally will be handled in the state or federal courts located in Clark County, Nevada, and both sides consent to that venue. Each side pays its own attorneys' fees unless a law says otherwise.

If any part of these terms turns out to be unenforceable, the rest stays in effect.

Changes to these terms

If we make meaningful changes, we'll update this page and the effective date, and ask you to review and accept the new terms the next time you sign in. If you don't agree with a change, you can cancel and delete your account — and if you're partway through a prepaid period and a meaningful change makes the Services materially worse for you, email us within 30 days of the change and we'll refund the unused part of that period. The version published here is always the current one.
